Terms and Conditions
This English version is provided for convenience only. The German version is legally binding.
1. Scope and Contracting Party
These Terms and Conditions apply to orders placed via the online shop at art-jungle.de.
The contracting party is:
Anas Ktesh, trading as Art Jungle
Brückenstraße 1B
10179 Berlin
Germany
Email: info@art-jungle.de
Telephone: +49 176 34619352
These Terms and Conditions apply to both consumers and traders, unless individual provisions state otherwise.
A consumer is any natural person who enters into a legal transaction predominantly for private purposes.
A trader is a natural or legal person or a partnership with legal capacity who, when concluding a contract, acts in the exercise of their commercial or independent professional activity.
2. Products
Art Jungle sells in particular art prints, posters, fine art prints, canvas products and other wall art.
The information on the respective product page at the time of order placement is decisive for material, size, design and scope of delivery.
Product photos and room visualisations serve to provide as realistic an illustration as possible.
Due to different screen and colour settings, colours of the actual product may differ slightly from the display on screen.
Frames, furniture or other decorations are only included in the scope of delivery if this is expressly stated in the product description.
3. Made to Order
Many of our prints are produced only after an order is received.
The production of a regularly offered product only after receipt of the order does not automatically result in the exclusion of the statutory right of withdrawal.
This may be different in the case of products custom-made to customer specifications.
This includes in particular individually agreed special sizes outside our regular product range, personalised prints, individually requested text or specially modified motifs.
4. Order Process and Conclusion of Contract
The presentation of our products in the online shop does not yet constitute a binding contractual offer.
The customer can select products and place them in the shopping cart.
Before placing the order, entries can be reviewed and corrected using the functions provided in the shopping cart and checkout.
By clicking the final order button, the customer submits a binding order subject to payment.
Receipt of the order will be confirmed electronically.
The purchase contract is concluded upon our express acceptance of the order, the corresponding order confirmation or the dispatch of the goods.
5. Contract Text
We store the contract and order data required to process the order in accordance with statutory requirements.
Following their order, the customer receives a confirmation by email.
The currently applicable Terms and Conditions can be accessed and saved on our website.
The languages available for the conclusion of the contract are displayed in the online shop or during the ordering process.
6. Prices
The prices displayed at the time of the order shall apply.
The prices quoted to consumers are total prices including statutory price components and value added tax (VAT), insofar as this applies.
In addition, shipping costs may be incurred.
Shipping costs will be displayed at the latest before placing the order subject to payment.
7. Payment Methods
The available payment methods are displayed to the customer during checkout.
Depending on the selected payment method, payment processing takes place in particular via the payment service provider Stripe.
Unless otherwise stated for a specific payment method, the purchase price is due upon conclusion of the contract.
8. Delivery Area
Art Jungle currently delivers exclusively to delivery addresses within Germany.
Delivery abroad is currently not offered.
9. Shipping
Shipping within Germany is carried out with DHL.
The shipping costs applicable to the order will be displayed during checkout.
For orders with a value of €75.00 or more, we offer free standard shipping within Germany.
10. Production and Delivery Times
Many of our products are only produced after the order is received.
The regular production and processing time is usually 2–3 working days.
In periods of particularly high order volume, processing can take up to 5 working days.
After handover to DHL, the usual shipping time within Germany is generally 2–4 working days.
Deviating delivery times indicated on a product page or during the ordering process take precedence over these general details.
11. Transfer of Risk
In the case of consumers, the risk of accidental loss or accidental deterioration of the goods generally only passes upon handover to the consumer or a person authorised by them to receive the goods.
For traders, the statutory provisions governing sale by dispatch apply.
12. Retention of Title
The delivered goods remain the property of Art Jungle until full payment has been made.
13. Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal for distance contracts.
Details can be found in our separate instructions on withdrawal.
For contracts where a statutory right of withdrawal exists and which are concluded via our online interface, we also provide an electronic withdrawal function.
There is no statutory consumer right of withdrawal for traders.
14. Custom-Made Products
The statutory right of withdrawal may be excluded in particular for products that are not prefabricated and for the manufacture of which an individual choice or determination by the customer is decisive or which are clearly tailored to personal needs.
Selecting a standard format regularly offered in the shop or producing a regular print only after an order is placed does not in itself constitute such customisation.
15. Voluntary 30-Day Return Right
In addition to the statutory right of withdrawal, Art Jungle grants consumers a voluntary return right for suitable standard products for a total of 30 days from receipt of the goods.
During the statutory withdrawal period, all statutory rights remain unaffected and in full force.
For returns after the expiry of the statutory withdrawal period, our separate return and refund conditions apply.
Custom-made or personalised products are excluded from the voluntary return right.
16. Warranty
The statutory provisions concerning liability for defects shall apply.
In the case of defective goods, the customer is in particular entitled to the statutory rights to supplementary performance and, provided the respective requirements are met, reduction of price, rescission and damages.
A request to report transport damage or defects in a timely manner does not constitute a forfeiture period for consumers.
17. Liability
Art Jungle is liable without limitation for damages caused intentionally or through gross negligence.
This also applies to damages arising from injury to life, body or health as well as in cases of mandatory statutory liability.
In the event of a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable damage typical for the contract.
Otherwise, liability for damages caused by slight negligence is excluded to the extent permitted by law.
18. Copyright and Usage Rights
The purchase of a print transfers ownership of the delivered physical product.
Copyright, reproduction, trademark or other usage rights to motifs, photographs, product images, texts or designs are not automatically transferred as a result.
In the case of public domain works, existing statutory usage possibilities remain unaffected.
19. Discount Codes
The respective promotional conditions apply to discount codes and special promotions.
As a rule, discount codes cannot be applied retrospectively to orders that have already been completed.
20. Consumer Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
21. Applicable Law
The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only to the extent that mandatory consumer protection regulations of the state in which they have their habitual residence are not excluded.
22. Jurisdiction
For consumers, statutory provisions regarding jurisdiction apply.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be Berlin, insofar as legally permissible.
